Abstract: What is Law: Reflections Starting from Quaestio 57 a.1 of the Summa Theologiae IIa IIae of S. Thomas
In light of the statements of S. Thomas in the Summa Theologiae on what law is, it emerges that it, as an accident pertinent to the categorical domain of quality, is the final object of just action. The author examines the specificity of criminal law, distinguishing between punishment in potentia and punishment in actu, concluding that the punishment imposed by the judge is a form of exercise of commutative justice.
