Abstract: The Reduced Obligation or the Law Without Force. Between the Dogmatics of Private Law and Jurisprudence
The analysis of the reduced obligation constitutes a deep reconstruction of a category of private law, which would bring to expression a happy synthesis between the “philosophy of law of jurists” and the scholars of the individual branches of law. In fact, it highlights the idea of a “law without force” and the physiological, and not pathological, presence of normative antinomies which derives from the tendency of the legal system to guarantee the widest possible space for private autonomy
