Abstract: Assisted Suicide in the Tension Between Courts and Legislators. A Novel Proposal
This paper examines the Italian legal debate on assisted suicide, focusing on recent Constitutional Court rulings and their impact on Parliament’s role. It highlights the tension between jurisdiction and legislation, the risks of medicalizing assisted suicide, and the limits of judicial activism. The author proposes an alternative approach: depenalizing assistance without imposing direct involvement on medical professionals.
