Abstract: From Environmental Law to the Law of Ecosystem Relations
The climate crisis, manifestation of a general ecological crisis of the planet, combined with the inability of the current system of environmental law to provide effective tools to combat it, should prompt the jurist to question the survival of traditional categories of “fossil law”. The author tries to undertake the task, proposing three changes: 1) a new branch of law dedicated to ecosystem relations, that is relations between human, non-human and the environment; 2) the recognition of a limited legal subjectivity to non-human beings; 3) the valorization of the intergenerational dimension of law, through the recognition of a limited legal subjectivity to past and future generations.
