Abstract: The Climate Issue as a Problem of Intergenerational Responsibility. Reflections Starting from a Recent Judgment of the European Court of Human Rights
Starting from a recent judgment of the European Court of Human Rights, which condemned the Swiss authorities for not adopting effective and timely policies to combat climate change, the contribution will reflect on the fact that such a contrast constitutes an intergenerational burden of responsibility. Only responsible choices made by the present generation and related to the climate issue, in fact, will be able to impact future generations in terms of benefit. Furthermore, it will be emphasized that this ruling, like other similar ones that preceded it, opens the way towards the possible full recognition of a specific fundamental right to climate, but at the same time, requires a reflection on the disorder of the sources of law and on the phenomenon of the hypertrophy of fundamental rights.
