Abstract: The Legal Transition in the Climate Transition. From the Anthropocentrism of Subjective Right to the Anthropocentrism of Duty in a Renewed System of Sources
The article starts from the reconstruction of the normative evolution in the field of environment and climate transition, highlighting its original structure. In light of this, it intends to propose an alternative perspective, not reductionist or individualist, which recognizes the founding value of certain social actions oriented towards an authentically transgenerational vision of the world, capable of effectively combining ethical demands and operational dimension, founding the system on the new concept of intergenerational duty that, overcoming the traditional approach based on subjective right, leveraging the natural normative and solidarity sociality of man, gives full implementation to the protection of the rights of future generations.
