Abstract: Deontology in Judicial Decisions and New Technologies
Artificial Intelligence (AI) has been put into practice in all fields of human activity, including the field of Criminal Justice and, therefore, it is already perceived as something accessible. At the same time, the dangers of its inappropriate use are also clear, especially because of the violations that it can cause to the fundamental rights of individuals. To avoid these dangers as far as possible, an ethical and legal approach to AI is needed. One of the valid instruments for the implementation of ethical and legal control of AI is the application of a correct deontology based on prudence, since it can constitute an adequate mechanism for the management of the risks that may arise. This article will attempt to establish the limits of AI in the application of criminal justice, in view of the opportunities and challenges it poses.
