Abstract: The Evolution of Decision Making Between Automatic Judgment, and Judicial Substitution
This article offers an analysis of judicial decision making, examining it from different perspectives. Initially, the emerging role of machines in the judicial context and the implications of their participation in decision making are explored. Through a consideration of the legitimacy of robotic judgments, the ethical and legal dilemmas associated with the acceptance of automated judgment are considered. Next, the focus shifts to the boundaries of the human intellect in decision making, interrogating the physiological limits of the judge and the role of experience and intuition in decision making. Finally, the issue of striving for perfection in the judge’s decision is examined, questioning the feasibility and appropriateness of such a goal in the legal sphere.
