Abstract: Carnelutti’s Lens and the Inadmissibility
Every legislative innovation can be evaluated with the filter of history. Thus it happens that the institution of inadmissibility coined by the legislator of the criminal trial has contents such as to expose itself – today – to the criticisms of those who – like Carnelutti, yesterday – observed that the criminal trial requires the simultaneous presence of the time of punishability and of the time of the judicial action. This binomial, however, appears mortified by the new cause of extinction of the process.
