Abstract: The Process “Marred” by the Corruption of the Cross-Examination
The focus of this essay concerns the equal treatment of the procedural parties in the italian trial. Especially following the last legislation, for the first time, there is a strong gap between the civil and criminal proceedings regarding the equality between prosecutor and defense attorney. While in the civil process this parity becomes more and more effective; the criminal trial, despite the very clear constitutional and ordinary legislation, still does not guarantee such equality.
