Abstract

In describing the contemporary situation of statual law, the A. attempts to recover the historical causes of this situation and describes the epistemological limits and the operational advantages of a legal dimension bound to the “legalism”; by honestly acknowledging today’s “nihilistic” drift, accor-ding to the A. it will be possible to recover the value of the right that is within every concrete fact and thus to entrust to the prudence of every experience an adequate juridical qualification.
