Abstract

The essay explores the discipline of quantification of non-patrimonial damages that is included in the Gelli Bianco’s law and highlights its old and new problems related, above all, to the referral to legal model of assessment of damages covered in the articles 138 and 139 of private insurance code (d.lg. 209/2005).
