Abstract

This paper critically analyzes the tortuous parliamentary process that led to the enactment of Law 3/2012, a rather difficult process, characterized by an overlapping of different legisla-tive interventions, layered in short time, different in content and in form. This process inevi-tably bears a difficult legislative language, often contradictory, which made the work of the interpreter even more difficult, to arrive to a “corrective” intervention of the same Judges, which had to implement application to a series of unclear, fragmented and often incomplete provisions.
