Abstract

In this study, regulations about the law of June 30, 2003, n. 196 (Regulatory Code in the field of personal data protection) will be analyzed. This Code regulates the data processing, which reveals health status in the health care field, in order to demonstrate, by means of reconstructing in real scope, the apparently special feature of the rules that control it. Even though the Code provides a discipline dedicated specifically for the Healthcare sector, it is not applicable to all Healthcare treatments. Alongside systematic issues, hypothesis are considered regarding the operation of data related to new resources such as: electronic health care records, health dossier and on-line reporting.
