Abstract

The work explores the philosophical roots of the concept of criminal law developed by Giuseppe Bettiol. Antonio Vernacotola, investigating the epistemological field, the “concrete logic” on the method and the philosophy of punishment, offers an interpretation of Bettiol’s penal doctrine focused on a metaphysical realism which has its main theoretical references in Aristotle and St. Thomas.
