Il diritto come arte: suggestioni e verità in Carnelutti

Abstract: The Law as Art: Suggestions and Truth in Carnelutti
What is the Law? Francesco Carnelutti’s reflections – in the most suggestive of his late works – revolve around a question without a clear answer. The jurist begins with questions and comparisons, leading the reader down a path already discovered by the Ancient masters. Once excluded the definition of law as an instrument of the ruling power, it appears sometimes as “shell,” sometimes as “duel,” others as “strength,” to reach the conclusion that, in the end, it is just another shape of love. Just as art is.
