Abstract: Some Brief Reflections on “Litigation” (at the Origins of a “Manifestly Metajuridical” Concept)
The notion of “litigation” has been used generically for centuries to indicate the legal process or its content. Francesco Carnelutti has instead elevated the litigation – assigning to it a technical-scientific meaning different from the common one – to a cornerstone of his theory of legal process and jurisdiction. Even in changes that the concept has undergone in the course of long activity of the Friulian scholar, it has continued to exhibit always a meta-juridical connotation.
