Abstract: Carnelutti and the Meta-Law
The legal doctrine of Francesco Carnelutti is based on extra-juridical grounds and uses several meta-juridical concepts. It appears to be built with naturalistic elements and reveals an ideological background. In particular, the author’s idea of the way in which legal effects are produced is open to criticism. The ontic conception adopted seems inadequate to grasp the essential deontic character of law.
