Abstract: Normativity: a Study on Structure, Function and Quantification
The research focuses on a semantic field for the terms normativity and norm that could avoid some fallacies in legal science. An empiricist and naturalist methodology is shown to be appropriate. Normativity is linked to the decision of the interpreting subject, as a specific cognitive activity. A definition of normativity is given, based on three structural components: time, representation, and trust. Some consequences related to the origin of normative legal thought in human history are analyzed.
