Abstract: Judgment Mediation Conversion. Francesco Gentile and the Philosophy of Litigation
The essay focuses on Francesco Gentile’s philosophy of litigation, starting from Capograssi’s and Opocher’s legacy. The possibility of ascertain the truth in legal adjudication has been questioned following the fall of the legicentric paradigm, and the consequent rise of ADR: these major events challenged the current assumptions in the theory of litigation, but Francesco Gentile’s idea of truth as “conversion” might still play a prominent role in understanding the inter-subjective meaning of truth in dispute-setting.
