Abstract

As it’s not possible to understand the economic and political development of the West without the consideration of the robbery that took place in the colonial countries from the 15th century, so the answers of the degrowth to the actual economic crisis of the West benefit from the analysis of the decision adopted with the New Costitution of the Republic of Ecuador (2008) of building «a new form of public coexistence, in diversity and harmony with nature, to achieve the good way of living, the “sumak kawsay”».
In the New Costitution of the Republic of Ecuador the notions of sumak kawsay and human dignity, which is expression of the western tradition, are complementary.The constitutional recognition of the Buen Vivir legitimates the nature as subject of law and sets the legal basis for the implementation of a new economy. It involves new forms of social organization, based on the common goods.
